Court fee for criminal cassaction appeal in Poland

The party attaches proof of payment of the court fee to the cassation appeal; this does not apply to the prosecutor. A person deprived of liberty does not pay a fee when filing a cassation appeal; If the cassation appeal filed by the applicant is left unrecognized or dismissed, a fee will be charged to the applicant. A soldier performing compulsory military service does not pay the fee. The fee is refunded to the party that paid it if the cassation is accepted, at least in part, or is withdrawn.

The Minister of Justice determines, by way of a regulation, the amount of the fee, taking into account the actual costs of the proceedings and the principle of access to court. If the person filing the cassation appeal was deprived of liberty after lodging it, but during the period in which he was obliged to pay the fee and did not fulfill this obligation until the moment of deprivation of liberty, he is exempt from the fee pursuant to Art. 527 § 2 of the Code of Criminal Procedure (V KZ 5/23).
