Formal requirements for an appeal in Poland

The appeal should meet the requirements for a procedural document and also include:

  • identification of the judgment against which it is brought, indicating whether it is appealed in whole or in part;
  • a concise statement of the allegations;
  • justification of the allegations;
  • citing, if necessary, new facts and evidence and demonstrating that their citation in the proceedings before the court of first instance was not possible or that the need to rely on them arose later;
  • an application to amend or annul the judgment, specifying the scope of the requested amendment or annulment.

In cases involving property rights, the value of the subject matter of the appeal must be determined. This value may be set at an amount higher than the value of the subject matter of the dispute indicated in the lawsuit only if the plaintiff has extended the claim or the court has ruled beyond the demand. An imprecise request to remedy the formal defects of the appeal means that it cannot be rejected due to failure to comply with the request, especially when it is addressed to a person who is not familiar with the procedural regulations regarding the correction of formal deficiencies in procedural documents (III UZ 20/2004).
